Law No. 03/2022/QH15 promulgated by the National Assembly on 11 January 2022 (“Law on Amendments and Supplements”) takes effect from 1 March 2022, amending and supplementing articles of the Law on Electricity No. 28/2004/QH11 promulgated by the National Assembly on 3 December 2004 (“Law on Electricity”) took effect from 1 July 2005.
The Law on Electricity is amended with notable points as follows:
- Adjustment of electricity development policies. To attract all economic sectors to participate in the construction investment activities of transmission power grids on the basis of ensuring national defense and security and following the electricity development planning, electricity generation and distribution, electricity purchase, electricity retail and specialized electricity consulting.
- Non-state economic sectors are allowed to operate the transmission grid they have invested in according to Article 6.1 of the Law on Amendments and Supplements.
- Adjustment of state monopoly activity. The State is monopoly of operating the transmission grid, except for the transmission grid built by non-state economic sectors according to Article 6.1 of the Law on Amendments and Supplements.
- Additional right of the power transmission entity. Connecting to the transmission grid built by economic sectors provided that the investment conditions and technical standards are satisfied according to Article 6.2 (a) of the Law on Amendments and Supplements.
- Additional obligation of the power transmission entity. Ensuring the connection rights of organizations and individuals engaged in electricity activities to the transmission grid invested and built by such organizations and individuals; in case of refusal to connect, the power transmission entity shall comply with the regulations of the Minister of Industry and Trade according to Article 6.2 (b) of the Law on Amendments and Supplements.
